Membership

Memberships are only available to residents living in the United Kingdom. The minimum age required to open an account is 16 years. People under the age of 16 are not allowed to use any of our services unless accompanied by a parent or guardian older than 18. The services are not available to people who have been permanently banned from our website or store. Once a membership card has been issued, it is only to be used by you. Under no circumstances will anyone else be able to use the same card. Membership cards are limited to 1 per person.

If you card gets lost or stolen, then you must inform us immediately so the account can be deactivated, the account holder will be responsible for any transactions made from a membership card when registered under them.

 

The username and password you chose when registering is to be used only by you and no one else. You are responsible for keeping your own username and password safe and ensure no one else is to get it.

When opening an account in store we require 2 forms of ID, one of which must include your photo and the other being a letter or utility bill which must bear your name and address and be valid within the last 3 months.

All of our items are graded and each item has a grading of its own which closely matches the criteria’s that we set.

Buying

In Store: Depending on what you are purchasing within our store you may be asked to show a form of ID in order to get said product, if you fail to provide ID upon request we are entitled to disallow your purchase.

 

Website: In order to purchase items from the online website www.gadcet.com you must be at least 16 Years of Age or Over, anyone who wishes to purchase an item that is under the age of 16 must do it through the supervision of an adult on their own account.

 

Gadget Exchange takes 100% responsibility if an item is found to be:

- Network blocked

- Reported lost or stolen,

- If there is outstanding finance by the previous owner

- Subject to insurance claim

 

If we find out the previous owner e.g. the person who sold the item to us, has done any of the above, we will do our investigation to find out the cause, and as a result we will replace your item as long as you have the receipt or if the IMEI / Serial number matches with our records. We either offer a like for like item, or a credit note of the current value of the item.

 

Selling

There are a variety of methods that you can use to sell to us:

 

In Store: To use this option you have to open an account with us, we have different levels of memberships available. To find out more take a look at the membership section.

 

Website: In order to sell to us on our website you must open an account with us and be at least 16 years or older.

 

When you sell to us -

We can reject items without a reason.

We can reject items if we believe it is stolen.

 

Before taking any item to sell we make sure to remove and wipe all personal information out. All items handed to us for testing are under your responsibility. We do not take any responsibility for the condition of the item such as scratches or dents. We are also not held liable if the item is found to be faulty or stops working.

If an item is found to be:

- Network blocked

- Reported lost or stolen,

- If there is outstanding finance by the previous owner

- Subject to insurance claim

 

We will contact you by phone or written letter to resolve the issue, however if the issue cannot be resolved directly through Gadcet, these following steps will take place:

- Network provider, Finance company or insurance company will be notified with your information.

- Police will be informed with your information.

- Bailiff company will be contacted; you will be liable for all bailiff fees.

- Court Hearing, you will be liable for all court fees.

You will also be liable for any other costs or fees e.g. administrator/solicitor fees, loss of profit or sales.

 

Any item sold to Gadcet belongs to Gadcet only.

Your use of this website and any dispute arising out of such use of the website is subject to the laws of each governing country.

 

Trade In

All Trade In vouchers that are given to you in exchange for your item or through other reasons are valid for 1 year only, after that time period they are unusable and you cannot claim the trade-in value from it anymore.

- Vouchers claimed from one store can ONLY be used at the original store that you have claimed said voucher from, there are no exceptions to this rule no matter the case.

- However Vouchers that are claimed from a store can be used  on our website for any order.

 

Website:

All Trade In vouchers that are gained through the online services are valid for 1 year only, after that time period they are unusable and you cannot claim the trade-in value from it anymore.

 

- Vouchers claimed from the online services can be used online, for any product available that offers a trade-in coupon section.

- However Vouchers that are claimed from online services on our website may be used within any store as long as you print off the voucher from the email sent to you and show it to us.

 

If you lose your voucher, give it to someone else,etc. then you no longer have any rights to the trade-in value that was given to you, we do not hold a record for these transactions and the trade-in value given to you so we are not to be held responsible if you are not able to claim your trade-in value.

 

These vouchers are a one-time use only with no exceptions no matter what the case is.

Risk of Loss

All items purchased from our website are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier.

 

Repairs

Warranty: All repairs carried out by us and our repair centres come with a 4 weeks to 3 months warranty dependant on the repair. This excludes any damage caused by the user. Any repair warranty becomes void if you cannot show us the repair receipt.

 

Quotation: All repairs quoted online are estimated based on the information you provide us. If there are any further problems discovered, your repair price may increase. We will contact you by phone or email for further verification.

 

Liability: Gadcet do not hold any liability for any Data which is lost or deleted you’re your product during the process of repair, you must therefore back up any data on your product before you hand it in to Gadcet Repair Centre.

No Fix No Fee: If your repair could not be carried out or cannot be completed, you will not be charged.

 

30 Days - Pick up Item or its Sold onwards to recover costs

 

If you give us an item to repair and do not pick it up within 30 days time, it will therefore be taken by us and added onto display for sale to make up for the recover costs. E.G. This doesn't apply if we agree to the terms made between us and the customer prior to the request given for more than 30 days.

 

Receipts: If you do not have your receipt when you come in to collect your item from repair we will not present you with your item until you can prove to us that you are the owner of the item or bring in the receipt.

 

Our Responsibility

We are responsible for the job that you have requested us to perform on your gadget, however we are not responsible for any damage to the phone caused prior to the repair or after the repair unless you specifically told us about them OR asked us to check the phone for extra problems, however if either of these are provided we will not repair the gadget until you give us the OK or ask us to repair other problems if any as well.

 

Deposits

We provide a 4 week instalment period for payments to be completed on any purchased products. A Deposit is payable at the start of the instalment period, this is usually 20% of the price of the product you are purchasing. After the 2 months instalment period, if the payment is not complete, any deposit left in will not be refundable or redeemed in exchange value.

Unless you show us a receipt for your deposit claim, we will not claim the item as your own and therefore you must pay the full price, not what you claimed is left after your deposit, UNLESS you show us your receipt of deposit.

If you lose this receipt, we are not held liable for your loss of deposit money as we do not hold records for these kinds of transactions outside of the receipt given to you.

 

Warranty

All items come with a specific warranty period, the durations of warranty range from 30 days to 3 months depending on the item. The warranty period will be displayed on the description of each product.

If any items become faulty within the warranty period, we first aim to repair your item which can take up to 10 working days, if the repair cannot be completed within 10 working days, we will offer you a replacement with an identical item, otherwise we will offer you an exchange credit note of the value of your item, this can be used to purchase any item from any of our stores.

 

Receipts - If you do not have a receipt your warranty becomes void and your item is no longer counted as being under warranty by us, however if you have proof of purchase through a bank statement then your warranty will be unaffected.

 

Delivery

We currently only deliver to a UK address. For security reasons we will only deliver the item to the billing address that is registered on the card used or to the home address that is registered to your online/store Gadcet Account.

We aim to dispatch any item purchased on our website within 3 working days, the tracking number of the delivery will be provided

Note: Saturday, Sunday and any Bank Holidays aren't classed as a working day for either dispatching or delivery of orders.

 

Postage

Postage Costs -

If we send your faulty goods back to you which you had planned to sell then we withhold the right to claim the postage and packaging costs from you.

If you send us our damaged goods back as a return, replacement or refund we will reimburse the postage and packaging costs to you.

 

Safe postage - All goods that are sent from us and to us must be sealed tightly and labelled with a fragile tag around it, the delivery service will need to know if they have to be careful with the package or not. If it arrives to us in an unsalvageable condition due to incorrect packaging then it will be sent back to sender.

 

Recording - All goods that are shipped out by us will be sent by recorded delivery through the company we choose to send the package with, and once it is sent off the tracking order for the package will be given to you so that you can see for yourself

 

Damage - All damage done to goods that are sent through the postal services is to be held responsible by the sender of said goods.

 

Us - If we send the goods to you and during the delivery to you they are damaged we will send you a replacement once you send us the damaged goods, we will NOT offer a refund for your damaged goods unless we do not have a replacement for you currently in stock.

 

You - If you send your goods to us and during the delivery they are damaged, then the amount of money you was quoted will go down based on the damage, and if you choose not to accept the changes then it will be sent back to you as it arrived. This also applies to sending us back our goods if you are returning them or getting a refund to them, any damage is entirely in your hands.

 

Rejected Sales

We have the right to refuse any sale that you give to us without a reason.

We have the right to refuse any customer who have an extensive smell of odour which may disrupt business by causing inconvenience to other customers.

We have the right to refuse any customer who is rude, who performs personal trade within our store premises or causes property damage within the store.

 

Payment

In Store: In order to purchase a product from Gadcet, you must pay by Cash or a valid UK Credit or Debit card.

Website: In order to purchase a product from Gadcet, you must use a valid UK Credit or Debit card or a confirmed PayPal account.

 

Special Offers

Special Offers are only eligible if you have a promotional code, we hold the right to decline any special offers if the date of the offers have expired, there are no exceptions to this rule no matter what is said on boards or leaflets. The only ones accepted are special offers from promotional codes before their expiry dates or special offers that are currently happening at the present time.

 

Recycling

We follow the WEEE(Waste Electrical and Electronic Equipment) Regulations when it comes to recycling

We follow the Reducing and managing waste policy as well as the Waste Legislations and Regulations set by the UK Standards. 

 

Buybacks

Notice: Upon signing a Buyback Agreement with us, you therefore are handing over all ownership of any item(s) that you are passing onto us. Therefore any items that are given to us become the property of Gadcet and Gadcet alone, we are merely giving you the chance to be the first customer to buy the item.

We handle buybacks at Gadcet and this is how they are handled.

- You bring in the item(s) you wish to begin the buyback process with into one of our stores

- We will then discuss why exactly you want to perform the buyback service

- Once that is done we will test the item(s) that you have provided us with, if they work we will give -you cash for them and then store them in a secure storage area with a guarantee for you to have the right to buy back the item(s) from us within the next 28 Days.

- Within 28 days time of the buyback process you can return and buy back your item(s) from us for the price we paid for them, plus an optional fee for the service provided.

- We allow the customer the right to extend the agreement by a further month through our one-off renewal option if we agree to the terms. Therefore they must pay the fee at the time of repurchase as well as the fee at the time of the renewal. After this no further extensions for our buyback agreement can be made.

In order for us to approve of the buyback process with you, you must:

- Be at least 18 years of age or over

- Provide 2 forms of ID, one of which must include your photo and the other being a letter or utility bill which must bear your name and address and be valid within the last 3 months.

If you leave your item with us for over 28 days without informing us or extending the duration then we reserve the right to place that item onto display, therefore meaning that you have lost your chance to buyback the item as the first customer as agreed upon within the buyback terms of agreement.

 

Acknowledgment of rights

You hereby acknowledge that all rights, titles and interests, including but not limited to rights covered by the Intellectual Property Rights, in and to the site, and that You will not acquire any right, title, or interest in or to the Program except as expressly set forth in this Agreement. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from any of our services, software, or documentation, or create or attempt to create a substitute or similar service or product through use of or access to the Program or proprietary information related thereto.

 

Fraud

FRAUDULENT ACTIVITIES are highly monitored in our site and if fraud is detected Gadcet shall resort all remedies available to us, and you shall be responsible for all costs and legal fees arising from these fraudulent activities.

 

CCTV

All our stores are monitored by CCTV Cameras 24/7.

CCTV Footage is held by Gadcet only and will only be disclosed to police if required.

We withhold the right to  deny access to our CCTV

                       

Trade Marks

Gadget Exchange, We Buy Gadget and We Fix Gadget are all registered trademarks of Gadcet.

 

Refunds and Returns

- If any items become faulty within the warranty period, we first aim to repair your item which can take up to 10 working days, if the repair cannot be completed within 10 working days, we will offer you a replacement with an identical item, otherwise we will offer you an exchange credit note of the value of your item, this can be used to purchase any item from any of our stores.

- We will not accept any returns if the item has been misused or damaged by you, or if the warranty has been void.

- We do not offer any refunds unless item is faulty

- Headphones are not refundable due to hygiene reasons

- DVDs/Games are not refundable; however they can be traded in.

 

Confidentiality

You agree not to disclose information you obtain from us and or from our clients, advertisers and suppliers. All information submitted to by an end-user customer pursuant to a Program is proprietary information of Gadcet. Such customer information is confidential and may not be disclosed. Publisher agrees not to reproduce, disseminate, sell, distribute or commercially exploit any such proprietary information in any manner

 

Non-Waiver

Failure of the Gadcet to insist upon strict performance of any of the terms, conditions and covenants hereof shall not be deemed a relinquishment or waiver of any rights or remedy that the we may have, nor shall it be construed as a waiver of any subsequent breach of the terms, conditions or covenants hereof, which terms, conditions and covenants shall continue to be in full force and effect.

No waiver by either party of any breach of any provision hereof shall be deemed a waiver of any subsequent or prior breach of the same or any other provision.

 

Editing, Deleting and Modification

We may edit, delete or modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a notice or a new agreement on our site. YOUR CONTINUED PARTICIPATION IN OUR PROGRAM, VISIT AND SHOPPING IN OUR SITE FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.

 

Miscellaneous

This Agreement shall be governed by and construed in accordance with the substantive laws of United Kingdom, without any reference to conflict-of-laws principles.

Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this Agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of United Kingdom, to the exclusion of any other courts without giving effect to its conflict of law’s provisions or your actual state or country of residence.

The entire agreement between the parties with respect to the subject matter hereof is embodied on this agreement and no other agreement relative hereto shall bind either party herein.

Your rights of whatever nature cannot be assigned nor transferred to anybody, and any such attempt may result in termination of this Agreement, without liability to us. However, we may assign this Agreement to any person at any time without notice.

In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.

If you would rather not have Gadcet keep you up to date with our news, offers and services then you will need to log into your account on the website and then update your personal contact information and preferences as to what you do and don't want from us.

 

Whilst having a store membership you are allowed to change your preferences in any of the UK stores or by sending an email to the email address above and providing within the email your name and address. Alongside this if you notify us beforehand that certain information that you have given us is to not be used for certain purposes then we will respect your wishes and we will not do so.
